Refusal to travel under the Labor Code of the Russian Federation: who cannot be sent on a business trip?
Since a business trip is one of the official duties of an employee, according to the law, refusal of a business trip is impossible. However, there are exceptions.
For example, pregnant women have the right to issue a refusal to travel on a business trip, regardless of the stage of pregnancy. Refusal for a business trip can be confirmed on the basis of a certificate from the antenatal clinic.
There are also categories of workers with children who can be sent on a business trip only with written consent. This is:
- Employees with young children (under 3 years old);
- Single parents with children under 14 years. These include both mothers and single fathers;
- A parent with a child under the age of 14, if the other parent works on a rotational basis;
- Employees with 3 or more children under the age of 14;
- Employees with disabled children.
It is important to note that employees of these categories must be informed upon signature of the right to refuse a business trip.
Therefore, answering the question about whether a business trip with small children is possible, we can say with confidence that at a minimum your employer must obtain your written consent.
